Massive Templates Terms of Use

1. CRITICAL INFORMATION
Please read the following Terms and Conditions carefully. Purchase and/or use of our products implies that you have read these Terms and Conditions and accepted them.

2. LICENSE
There are three possible license types that our website may grant to use the Flash templates (the "products") sold through our website by independent content providers in accordance with these Terms and Conditions (the "license") issued by our company, as follows:

a) SINGLE USE LICENSE
A Single Use License may be granted when purchasing a Flash template at a fixed price. This allows you to use each individual product to create one single website only, whether this website belongs to you or your client. To use the same design you must purchase the same template again for additional projects;

b) DEVELOPERS LICENSE
A Developers License allows you to make certain modifications on the products using any type of software or application and Massive Templates web designs. You may redistribute or resell your finished product after receiving the license. You may apply for a license at contact-us@massivetemplates.com;

c) BUYOUT PURCHASE LICENSE
You may be granted a Buyout Purchase License if you purchase a Flash template at the Buyout Purchase Price. This license type guarantees that you are the end consumer of this Flash template. After a buyout purchase takes place, the template will be permanently removed from Massive Templates’ template galleries and will never be available to other customers again. You may not redistribute or resell a template after purchasing with a Buyout Purchase Price.

3. IMAGES, CLIP ART ITEMS AND FONTS
All the images, clip art items and the fonts used in our Flash templates are royalty-free and are considered an integral part of our products. A Single Use License and a Developers License grant rights to use the images, clip art items and fonts, but only as an integral part of the website you create using the Flash template you purchased at our site. You may use images, clip art items and fonts to develop one project only. Any unconnected use or distribution is strictly prohibited. Each image and illustration used in the templates provided by us comes in a single layer.

Some of the Flash animated templates may include special effects created with the following software packages: Adobe AfterEffects, 3DMax. To find out whether effects like these are used in a specific template please contact our Support Team.
Please note that in order to edit these effects you will need the suitable software and skills. You may also hire someone to edit it for you.

4. MODIFICATIONS
As a purchasing client you are entitled to make modification(s) on our products and to customize them to suit your needs and purposes. All this in accordance with the type of license you purchased.

5. UNAUTHORIZED USE
Unless you have purchased the Buyout License, you may not save any of our products, modified or not, on a diskette, CD, website or any other medium. In addition, you may not offer them for any type of redistribution or resale without receiving prior written consent from our company.

6. ASSIGNABILITY
You may not sublet, assign, or transfer any of this website’s products to any entity or body, without receiving prior written consent from our company.

7. OUR REFUND POLICY
Since Massive Templates provides non-tangible, irrevocable goods, we do not issue refunds after product shipping, a fact that is made known to you prior to making any purchase at our site. Please make sure that you've read our Terms & Conditions carefully. The only exceptions to this rule may occur if a product has been proven to be other than what was described, and this on a case by case basis, and at our sole discretion. In this case, the refund will be issued after we receive a signed Waiver of Copyright.

8. OWNERSHIP
You may not claim intellectual property rights or exclusive ownership over any of our products. All of our products belong to independent content providers. Massive Templates’ products are provided without any warranty, either expressed or implied. Our company or its agents shall not be held liable for any damage that may occur, including, but not limited to, direct, indirect, special, punitive, incidental or consequential events, or any other loss that may occur as a result use of or inability to use our products.

9. ANTIFRAUD CHECK
Customer purchases may be delayed for 10-20 minutes for a manual antifraud check and may also be suspended for a longer time period in the event of an investigation. Antifraud checks take place due to the growing number of fraudulent transactions by individuals who are not actual cardholders.

10. THIRD-PARTIES SERVICES
Massive Templates may use third party services to provide certain services that are accessible only through the website. Massive Templates has no power over these third parties’ or their services. You agree that Massive Templates will not be held liable to you in any way in case you choose to use such services. These third parties may have their own policies and terms of use. You hereby agree to comply with such terms and policies in addition to these. If any of these terms or policies conflict with Massive Templates terms, agreements or policies, Massive Template’s policies will receive precedence.

11. LAW AND JURISDICTION
By accessing the Massive Template website, you agree that all matters relating to access and use of this website and/or its products shall be governed by the statutes and laws of the USA, regardless of the principles of the conflict of laws. The parties specifically disclaim the U.N. Convention on Contracts for the International Sale of Goods.

12. INFORMATION DISCLOSURE
You are not permitted to disclose any information on your order, including, but not limited to the Order ID, the download link and more.
Massive Templates reserves the right to change, modify and alter the terms and conditions without prior notice.
